Wedding bans

TMarriage banns are mandatory only in the case of a marriage to be celebrated in Italy, whether it is contracted with a civil or religious ceremony.

The request for marriage banns at this Consulate General can only be made on condition that at least one of the future spouses is an Italian citizen residing in the States of Victoria or Tasmania and is registered with AIRE at this Consulate General.

The request can only be submitted within six months preceding the date of marriage.

If one of the engaged couples is resident in Italy, they must apply for marriage banns directly with the Italian Council where they reside.

Both spouses, regardless of their nationality, must always come to their appointment with an identification document.

WHAT TO BRING TO YOUR APPOINTMENT TO REQUEST MARRIAGE BANNS

For Italian citizens
  1. Valid passport;
  2. Banns application form, pre-filled but not signed;
  3. Confirmation of the wedding booking, issued by the Italian municipality chosen by the bride and groom;
  4. Statutory declaration (click here);
  5. If the applicant is divorced and the divorce has not yet been registered in Italy, they must provide the divorce certificate or decree nisi with an Apostìlle and translation into Italian;
  6. If the applicant is a widower of an Italian citizen and the death certificate has not yet been registered in Italy, he/she must provide a death certificate of the previous spouse with an Apostìlle and translation into Italian.
For foreign citizens (NOT Australians)

If the foreign national is an Australian citizen, they must obtain a document called “Atto Notorio” (click here)

  1. Full birth certificate;
  2. Original certificate of Single Status (“single status, no record result”);
  3. Any divorce certificate or death certificate of previous marriages. If the ex spouse/deceased spouse is an Italian citizen, this certificate must be provided in original with Apostìlle and translated into Italian;
  4. Certificate of no impediment to the marriage. This is to obtain from the relative Embassy and it must then be presented to the Municipality where the marriage will take place. It is therefore important to contact well in advance the Embassy to enquire about the requirements and the time needed for the issuing of this non-impediment certificate.

Once the assessment and acquisition of the documentation have been completed, the Consulate General will publish the notice of marriage on the consular register (also electronically) for 8 consecutive days, after which a certificate of publications is sent by e-mail to the Municipality chosen by the bride and groom.

The total cost of applying for marriage banns is approximately AU$50 payable by debit/credit card.
